must first agree to the Terms and Conductions as set forth in this
Agreement. You may not use the
services if you do not accept the Terms.

to the Terms and Conditions when registering for a course on Our

ACCESS/LICENSE
Your use of Our Site grants
you a non-exclusive, non-transferrable license to access the courses on Our Site
for a period of six (6) months for personal, non-commercial transitory viewing

our sole discretion to be inappropriate or offensive or that otherwise breaches

disseminated or used by HeartSaving Solutions for any purpose whatsoever,

Our name and logo are
proprietary trademarks of HeartSaving Solutions LLC. Permission to use our logo
for World Wide Web display must be obtained prior to use.

indicated. All rights are reserved. You may not modify, transmit, license,
create derivative works from, reproduce, download, disseminate, publish,

HeartSaving Solutions does not warrant that access to the service and the web

HeartSaving
Solutions does not guarantee or certify that students who have participated or
successfully completed our courses will be able to perform CPR in an actual
emergency. Our role is to provide education to the student with the scientific
national guidelines.
LIMITATION OF
LIABILITY
We will not be liable to
you or any third party claiming through you for any damages in connection with
the use or inability to use Our Site or any content appearing on Our Site. In no event will HeartSaving Solutions be
liable to you or any third party for any indirect, consequential, exemplary,
punitive, special, or incidental damages, including without limitation, personal
injury or death, loss of data, lost revenue, lost profits, loss of use or other
economic advantage, change in applicable government regulations, regardless of
the form of the action and regardless of whether HeartSaving Solutions has been
advised of the possibility of such damage. Notwithstanding the foregoing
limitations, in no event will the total, cumulative liability of HeartSaving
Solutions for damages under this Agreement exceed the amount you tendered to
HeartSaving Solutions under this Agreement.
TERMINATION
Your access to and use of
Our Site may be terminated at any time for any reason or for no reason by you or
by us by the sending of notice to the other party.
PAYMENT
POLICY
All orders are processed
through PayPal’s website, and at no time do we have access to any billing
information. All information
required to process your payment is entered into and processed by PayPal and
subject to PayPal’s Terms of Use and Privacy Policy as set forth on PayPal’s
website. By electing to pay using
PayPal, you agree to the terms of PayPal’s Terms of Use and Privacy Policy and
agree to hold us harmless from the unauthorized use or disclosure or any other
claim related to your billing information.
Once your
payment is processed, you will be granted access to the cours(es) you have
purchased.

Any controversy or

these Terms and Conditions will be governed by Washington law, excluding its conflict and
choice of law principles. The exclusive jurisdiction and venue for any claims

Superior Court of King County in the State of
Washington. The failure, neglect, or delay of
HeartSaving Solutions to enforce any right or provision in these Terms and
Conditions will not constitute a waiver of such right or provision. In the event
that a court of competent jurisdiction finds any provision of these Terms and
Conditions to be unlawful, invalid, or unenforceable to any extent, the
remaining portions will remain in full force and effect to the fullest extent
permitted by law.
Should any part of the
Terms of Use be declared invalid or unenforceable by a court of competent
jurisdiction, this shall not affect the validity of any remaining portion and
such remaining portion shall remain in full force and effect as if the invalid
portion of the Terms of Use had been eliminated.
This Agreement is governed
by the laws of the State of Washington, without regard to principles of
conflict of laws.
To the extent you have in
any manner violated or threatened to violate HeartSaving Solutions’ and/or its
affiliates' intellectual property rights, HeartSaving Solutions and/or its
affiliates may seek injunctive or other appropriate relief in any state or
federal court in the State of Washington, and you consent to exclusive
jurisdiction and venue in such courts.
Any other disputes will be
resolved as follows:
If a dispute arises under
this agreement, we agree to first try to resolve it with the help of a mutually
agreed-upon mediator in the following location:
King County, Washington. Any costs and fees other than
attorney fees associated with the mediation will be shared equally by each of
us.
If it proves impossible to
arrive at a mutually satisfactory solution through mediation, we agree to submit
the dispute to binding arbitration at the following location:
King County, Washington, under the rules of the American
Arbitration Association. Judgment upon the award rendered by the arbitration may
be entered in any court with jurisdiction to do so.
